Privacy Policy

How MATIK NA 'YAN handles the personal information you share with us through this website.

Effective date: 2026-11-02

1. Who we are

This website, matiknayan.com, is operated by Van Jomel Marinay Garcia, an individual, who uses MATIK NA 'YAN as the brand name of an owner-operated service agency (“we”, “us”). MATIK NA 'YAN is a brand name only; it is not a separately registered business name, partnership or corporation.

For personal information submitted through this website, Van Jomel Marinay Garcia is the personal information controller under the Data Privacy Act of 2012 (Republic Act No. 10173).

Location: Cavite, Philippines. This is a general location, not a mailing address. Please contact us by email at hello@matiknayan.com.

2. What this policy covers

This policy covers personal information collected through this website, mainly through our project inquiry form. It does not cover systems we build or operate for clients. Those are governed by separate agreements with each client.

3. Information we collect

When you submit the inquiry form, we collect:

  • your full name;
  • your business name;
  • your email address;
  • your phone number, if you choose to provide it;
  • the service you are interested in; and
  • your description of the business problem.

Please do not include sensitive personal information (for example health, financial account, or government ID details) in your description. We do not need it to respond to an inquiry.

When you visit the website, our hosting provider automatically processes technical information such as your IP address, browser type, and the pages requested, in order to deliver and secure the website. When you submit the form, our server also uses your IP address briefly to limit repeated submissions. We do not store it with your inquiry.

To protect the inquiry form from spam, the contact page uses Cloudflare Turnstile. When you load that page, Turnstile processes signals such as your IP address, browser and device characteristics, and the page you are on, to check that the form is being used by a person rather than an automated program. See Cloudflare's Turnstile Privacy Addendum for details.

This website does not use analytics or advertising trackers, and it does not set cookies of its own.

4. How we use your information

We use the information you provide to respond to your business inquiry, communicate with you, arrange requested discussions, and prepare proposals or quotations. We also process limited technical information to protect the website and inquiry form from spam and abuse.

Specifically, we use it:

  • to send one automatic email to the address you entered, acknowledging that we received your inquiry. It shows only the service you selected and the submission date. It does not repeat your name, business name, phone number or message;
  • to read and respond to your inquiry;
  • to arrange and hold a discovery call, if you want one;
  • to prepare a proposal or quotation you request; and
  • to protect the website and inquiry form from spam and abuse.

We do not sell your personal information, and we do not add you to marketing or newsletter mailing lists from an inquiry.

5. Legal basis for processing

Under Section 12 of the Data Privacy Act of 2012, we process inquiry information because it is necessary to take steps you request before entering into a possible agreement with us and, if you become a client, to perform that agreement. We process technical information, including for spam and abuse protection, based on our legitimate interest in keeping the website and inquiry form secure and available. Where we keep information longer as described in Section 8, we do so to comply with a legal obligation or, for legal claims, based on our legitimate interest in establishing, exercising or defending them. We rely on legitimate interest only where it is not overridden by your fundamental rights and freedoms.

6. Who we share it with

We share personal information only with service providers that help us run the website and receive inquiries:

  • Vercel Inc.: website hosting and delivery.
  • Resend: our transactional email service. It processes the content of the emails it delivers: the inquiry notification to our inbox, which contains everything you submitted including your full message, and the automatic acknowledgment to you.
  • Cloudflare, Inc.: spam protection for the inquiry form (Cloudflare Turnstile). Cloudflare processes Turnstile signals on our behalf to detect automated abuse, and also uses them for its own purpose of improving its bot-detection service, as described in its Turnstile Privacy Addendum.
  • Email inbox provider: Zoho Mail (Zoho Corporation), with messages to hello@matiknayan.com also forwarded to a Gmail mailbox (Google LLC), where inquiry emails and your replies to us are received and stored.

We may also disclose information when required by law or by a lawful order of a government authority.

7. Processing outside the Philippines

Some of our service providers operate servers outside the Philippines, including in the United States. Your information may therefore be transferred to and processed in other countries.

8. How long we keep it

We keep inquiry emails for 12 months after the last relevant correspondence about your inquiry. The period is measured from the most recent relevant message in the conversation, whether sent or received, not from the date of your first message.

This applies to the inquiry notification, our replies and follow-ups, and any related attachments, both in our Zoho Mail mailbox and in the copies forwarded to our Gmail mailbox.

We keep information longer only where it is still needed: while you are an active client, where a law requires us to keep it (for example, accounting or tax records), or where it is needed to establish, exercise or defend legal claims. Records of a client engagement are kept according to that engagement's agreement and applicable law.

When the retention period ends and no exception applies, we delete the inquiry emails from our active mailboxes. Deleted email is not erased instantly: it can remain for a limited time in the email providers' trash, recovery and backup systems before the provider removes it.

According to their published documentation (as of November 2026), Gmail permanently deletes messages 30 days after they are moved to Trash, and Zoho Mail keeps deleted messages in Trash for a configurable period and then retains them for up to 30 more days, during which they can be recovered, before purging them. Any backups are governed by each provider's own policies.

Resend, which sends the inquiry notification and the automatic acknowledgment, keeps its own records of the emails it sends, which may include their content, for a period it controls: 30 days on its standard plans, according to its published pricing (as of November 2026). Our hosting provider keeps technical logs for a limited period under its own settings.

You can ask us to delete your inquiry before the period ends. We may need to confirm your identity first, and we may keep information that one of the exceptions above requires; if so, we will tell you. Send deletion requests to hello@matiknayan.com.

9. How we protect it

The website is served only over encrypted HTTPS connections. Credentials for our email delivery service are stored on the server and are never sent to your browser.

Access to our Zoho Mail and Gmail mailboxes containing business inquiries is restricted to the individual operating MATIK NA 'YAN. Our service providers also process information as described in Section 6.

10. Your rights

Under the Data Privacy Act of 2012, and subject to the conditions and limits it sets, you have the right to:

  • be informed about how your personal information is processed;
  • access your personal information;
  • object to processing, including processing based on our legitimate interests;
  • correct (rectify) inaccurate or incomplete information;
  • have your information erased or blocked where the law allows, for example where it is no longer necessary for the purpose it was collected for;
  • obtain a copy of your information in an electronic, structured and commonly used format, where it is processed in that way (data portability); and
  • be indemnified for damages sustained because of inaccurate, incomplete, outdated, false, unlawfully obtained or unauthorized use of your personal information.

Your lawful heirs and assigns may exercise these rights in certain cases. We may need to confirm your identity before acting on a request. If you believe your rights have been violated, you may file a complaint with the National Privacy Commission.

To exercise your rights or ask a question about this policy, contact us at hello@matiknayan.com.

Our data protection officer is Van Jomel Marinay Garcia, who can be contacted at hello@matiknayan.com.

11. Changes to this policy

We may update this policy when our practices or legal requirements change. The effective date above shows when it was last revised.
